Ad portas del examen periódico Universal (EPU) sobre la situación de derechos humanos en Colombia, vergonzosamente el Consejo de Estado anuló la destitución del General Álvaro Velandia Hurtado como responsable de la desaparición forzada de Nydia Erika Bautista por razones de forma, al considerar que a la Procuraduría se le vencieron los términos legales para notificarle su destitución en 1995. El fallo condena a la Procuraduría a pagar al General todos los sueldos dejados de recibir desde 1995.br
